Terms and conditions

These terms apply to orders placed on ArtifyMe for personalized products created from the materials provided by the customer.

Seller

ARTIFYME is a trade name operated by SBCA CONSULTING, a French SAS with share capital of €1,000, registered with the Versailles Trade and Companies Register under SIREN 939 852 117, head office SIRET 939 852 117 00018, intra-Community VAT number FR36939852117, with registered office at 2 Mail des Tilleuls, 78180 Montigny-le-Bretonneux, France. Order

The customer selects a product, adds photos, text, views and customization options, then checks the preview and order information before confirming. The order is considered confirmed after payment.

Personalized products

ArtifyMe products are made to order from the photos, text and options provided by the customer. The customer is responsible for the quality, crop and usage rights of the submitted materials. AI styles transform the submitted image into personalized artwork and may include slight artistic variations.

Prices and payment

Prices are displayed on the website at the time of order. Payment is secured through Shopify and must be confirmed before production starts. Shipping fees, taxes and possible customs fees depend on the delivery country and the information shown at checkout. The seller and issuer of sales documents is SBCA CONSULTING, trade name ARTIFYME.

Review and production

Orders are reviewed before printing to limit obvious crop, view or file issues. This review does not replace the customer's responsibility for the submitted materials. Production and shipping are made to order with technical partners, including Printful.

Delivery

In France, fees are calculated in the cart and tracked shipping is automatically free from a €49 purchase. In other European Union countries, fees are calculated from the product, address and available fulfillment center. Products are made to order and then shipped with tracking when available. Timings may vary depending on the product, destination country, carrier, customs and period.

Returns and refunds

Under Article L. 221-28, 3° of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer's specifications or clearly personalized. Because ArtifyMe products are made especially from the materials approved by the customer, they cannot be returned for a simple change of mind. This exception does not affect the statutory conformity and hidden-defect guarantees.

Previews and final result

Previews shown on the website serve as the customization reference. The final result may vary slightly depending on the real crop, product texture, print colors, technical production constraints and requested AI transformations.

Statutory guarantees

SBCA CONSULTING, 2 Mail des Tilleuls, 78180 Montigny-le-Bretonneux, France, is responsible for the statutory guarantees. Requests can be submitted through the contact form or to contact@artifyme.fr.

The consumer has two years from delivery of the goods to invoke the statutory conformity guarantee if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared.

Where the sales contract provides for continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that digital content or service throughout the agreed supply period. During that period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or service, not the date on which it appeared.

Where applicable, the statutory conformity guarantee requires the professional to provide all updates necessary to maintain the conformity of the goods.

The statutory conformity guarantee entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the statutory conformity guarantee, the initial guarantee is extended by six months.

If the consumer requests repair but the seller requires replacement, the statutory conformity guarantee is renewed for two years from the date of replacement.

The consumer may keep the goods and obtain a price reduction or terminate the contract and receive a full refund against return of the goods if:

  1. the professional refuses to repair or replace the goods;
  2. repair or replacement takes place after thirty days;
  3. repair or replacement causes major inconvenience to the consumer, including where the consumer ultimately bears the cost of taking back or removing the non-conforming goods, or the cost of installing the repaired or replacement goods;
  4. the lack of conformity persists after the seller's unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to an immediate price reduction or termination of the contract where the lack of conformity is sufficiently serious. The consumer then does not have to request repair or replacement first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are immobilized for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

These rights result from Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who acts in bad faith to obstruct implementation of the statutory conformity guarantee may incur a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the statutory hidden-defect guarantee under Articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or a full refund against return of the goods.

Consumer mediation

In accordance with Articles L. 612-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge to seek an amicable resolution of a dispute with SBCA CONSULTING (ARTIFYME). After first submitting a written complaint to ARTIFYME’s customer service which has not resolved the dispute, the consumer may refer the matter to SBCA CONSULTING’s appointed mediator: CM2C – Centre de la Médiation de la Consommation des Conciliateurs de Justice, 49 Rue de Ponthieu, 75008 Paris, France. Mediator website: www.cm2c.net. Online referral: CM2C referral form. Referral email: declarer-un-litige@cm2c.net. The request for mediation must be submitted within one year of the written complaint sent to ARTIFYME.
